CA Harbors & Navigation Code 655

  • That you cannot operate a boat, water skis, aquaplane or similar equipment while under the influence of alcohol and/or drugs. The BUI laws only pertain to motor propelled boats or pulled equipment. For example, you can't be arrested for a self propelled device like a kayak or raft.
  • Prohibits operating any of the listed equipment  if your blood alcohol concentration is 0.08% or above as measured by blood/breath test.
  • If you are a commercial operator you cannot operate a commercial boat if your BAC is 0.04% or greater (Harbors and Navigation Code 655d).
  • You will be penalized for operating a boat or any other equipment listed while under the influence of alcohol and/or drugs if you injure another as a result (Harbors and Navigation Code 655f).
  • You are allowed open containers of alcohol to consume on a boat as a driver or as a passenger.  Violation of the law occurs only if you operate water devices while under the influence of alcohol and/or drugs.
  • Since 2008, the DMV does not revoke or suspend your driver's license following a BUI conviction.
  • Simple BUI - operation of a boat, water skis, an aquaplane or similar equipment while under the influence of alcohol and/or drugs.  A BAC of 0.08% is required for presumption that you were DUI at time of arrest.
  • BUI with BAC of 0.08% or higher - operation of a boat, water skis, an aquaplane or similar equipment with a BAC of 0.08% as measured by blood/breath test.
  • Aggravated BUI - BUI causing injury under H&N Code 655f. You were DUI and broke a law while operating water equipment or drove in a negligent manner that caused injury to another.
  • BUI Manslaughter - you committed a simple or aggravated CA BUI. You committed an additional grossly negligent act (not amounting to a felony) and your negligence caused the death of another.
